The jury selection process in the trial of accused Toomer's Corner oak poisoner Harvey Updyke only just begun Tuesday, but if Updyke's comments to the Auburn student newspaper are any indication, he may have already lost the stomach for his impending legal battle.

The Plainsman reported Tuesday that when asked about his alleged crime outside an elevator at the Lee County Justice Center, Updyke readily admitted to having poisoned the famous Auburn landmark.

“Did I do it? Yes,” Updyke reportedly said.

“They're going to find me guilty… it's a done deal,” he added. “I don't think I'm going to get a fair trial.”

An attorney's worst nightmare. He keeps digging his grave a little deeper every time he opens his mouth. He needs to plea bargain at this point and hope for the best.

He'll be pardoned.  This entire trial is a joke.

I like trees, but they're trees.  If a person can spend just 5 years in jail for murdering another person, no way Harvey should spend much time at all for killing trees.

A guy cut down 15 mature pine trees on my property the day after I showed him the marked property line.  He paid a $150 fine (the same amount he got for the lumber).   :tinfoil: :tinfoil: :tinfoil:

What's he going to do?  They already have him on radio and TV broadcasts admitting to it, so denying it now just makes him look like a liar.  And I expect no plea deal was offered by the Auburn DA, excepting some serious jail time.  So all he can hope for is to come clean and hope the punishment fits the crime.  The hardest decision for his lawyer is whether to put Harvey on the stand.  Do you have him apologize and say he went crazy temporarily, or do you keep him quiet?

He needs to plead quilty in exchange for a plea bargin of community service or some reasonable punishment. This is not a jail time sentence. This should be a bench decision and not a jury trial to begin with. This is costing tax payers way too much money.

Well, if he goes to jail, there will be lots of ex-AU football players to chat with.

The one amusing aspect of this whole debacle that I just recently thought about is that many times you will see environmentalist wackos weeping or getting angry over the "death" of a tree. In this case, the wackos aren't saying a word; only the barners are upset. That should say quite a bit right there.
