Common sense tells a college football player what the laws of the state are that is no excuse. RTR!

The car was parked in a parking lot and DH was in the driver's seat. 

That's all that Alabama law requires for a DUI charge, under the premise that someone in the driver's seat is in "control" of the vehicle.

Personally, I've always found that logic a bit of a stretch. 

If the car isn't running and the person is asleep, control seems a potentiality, not a reality. 

But we still don't know all the facts.

Suppose he got to his car, realized he shouldn't be driving, and decided to sleep it off instead.  Does he deserve the same punishment as someone actually driving drunk? 

Saban will get to the bottom of it, if he hasn't already, and mete out the appropriate punishment.

IMHO...if DeShawn parked the car because he realized he was in no shape to drive, that makes some difference.  Even so, still a lot of bad judgment to get to that point.

What if he wakes up and drives off and kills someone? That's what used to happen and why the law was passed. A drunk would be found asleep in his car and nothing could be done about it. If you are going to drink, have a sober person drive you home or call a taxi. Heck, call a coach to come get you. The law is a good thing and makes total sense. Over 10,000 folks killed by drunk drivers in 2016, total waste of life for what, to "feel good?" Plus, tens of thousands injured and crippled for life by an idiot drunk. No excuses.

I have to agree with MD. There is no excuse for getting behind a wheel of an automobile that will run fast if you are drinking. The wreck I spoke of close to our house that killed the woman and really bad injured the other 2 in the car with her they had just left the store where we volunteer and the State Trooper said one of the ladies driving was drinking. She was on the wrong side of the road and killed a good Christian lady but regardless there is no reason to kill anyone. It is not that MR hand killed anybody but the potential is there from where he was to where he parked or whatever. I DO trust CNS to handle the problem. RTR!

The lawyer in me says this is a "slippery slope" rationale.  That's convicting someone of a crime that hasn't actually been committed.  Suppose he is in the passenger seat -- the same question could be posed.  ("What if he wakes up and drives off and kills someone?")  But in the passenger seat, he would have avoided a DUI charge. 

I think the law became this way because originally police officers had to see someone operating a vehicle for a DUI charge -- changed so that if he is behind the wheel but the vehicle is not moving it can be presumed that he was driving (like when the officer comes upon a wreck, a vehicle on the side of the road or a similar situation where the drunk is passed out behind the wheel after driving.)  That makes sense to me.  But I'm not a big fan of this approach without some evidence that the vehicle was actually operated, precisely because it potentially punishes someone who made the right decision not to drive.

Not trying to justify DUI, which is a terrible tragedy waiting to happen.  But you got me talking about the law....   ;)
