He was taken to a hospital early on Sunday morning before being transported to University Medical Center where he passed away on Tuesday. Two men were arrested. If two people beat one man unconscious (particularly if they beat on him after he was unconscious), it looks like a there would be a charge a little stiffer than manslaughter for at least the initial charge. If someone threw a punch and some freak accident happened where he hit his head on something falling down, then maybe not. But since two men were involved, it sounds like a more malicious event than that. I'm by no means a criminal law expert -- in my limited experience, DAs do exactly what you suggest, overcharge and then plead down. But that might be different in a small town. And there have to be facts supporting the charge. :unsure: |
