Title: Property line disputes Post by: ssmith general on March 18, 2011, 05:58:19 AM Anyone have any experience here?
My adjoining property neighbor seems to think about 20-25 feet of my property is his along one of the lines and about 5 feet every where else. I am thinking about having it resurveyed and staked out every 10 feet. Would that be obnoxious? Is it worth messing with? We do not get along already. We used to share a circled driveway, but the first thing he did was close it off, so I had to rework my driveway. Total prick. Discuss. Title: Re: Property line disputes Post by: Flyboy on March 18, 2011, 06:03:45 AM Have it surveyed.
Title: Re: Property line disputes Post by: SUPERCOACH on March 18, 2011, 06:04:48 AM I vote for the survey.
Title: Re: Property line disputes Post by: BAMAWV on March 18, 2011, 06:06:43 AM There is some kind of real estate law where if he claims and uses the property as his own for 10+ years it becomes his. IDK if this is fact or fiction nor the specifics but our crack legal dept on this pacle should be alerted.

That's called an understood easement or something like that, It doesnt become his, but you cant stop him from using it technically, but we already went through that with the driveway. I could have made him let me continue to use it, but it wasn't worth it. Title: Re: Property line disputes Post by: CrimsonCrusader on March 18, 2011, 07:02:11 AM Survey

Problem is, it's a long border. probably 380' then turning and going another 800' or so. If only I had a new tractor with a post digging attachment. Think people would need that too? I usually dig a hole, pound in the fence post (deeper than the bottom of the hole), dump dry quickcrete in there, splash some water in there, stir it around a little, and top it with dirt. They are solid as rock in a few hours and not that hard to remove either. I have never had a fence project where I was not on a time table, always mending so you want it to be a one day thing. I have fence everywhere on my property, it used to be separated into chickens, pigs, and two cow areas. Fence pullers. Mine have two plates that bolt together, rather than hooks. Title: Re: Property line disputes Post by: XBAMA on March 18, 2011, 08:03:42 AM I saw a couple of my neighbors go through something like this
there was the one guy that built the fence and the other butthole neighbor I laughed every time I passed ... because during the construction of the fence he put up one of those big blue tarps along where the fence was going to be and everyone that passed could see it .. the message was pretty clear on the tarp in big white letters it said ... While it may hit your wallet now,it may give you some peace of mind later. How long BTW have ya'll been neighbors?

The neighbor won't shut up until the issue is resolved. Then I'd consider a good fence and plants along it so I couldn't see the neighbor's yard!

You need to have it surveyed and have them put a piece of metal just underneath the earth on all 4 corners. Don't put stabs they can be pulled up and tape is OK for a couple of winters but the metal will never be lost. RTR!

We have those, problem is it is not even close to square and he had it surveyed when he bought it. Or at least some stakes appeared. But the tax map couldnt be any more obvious he is over the line by several feet. Just a simple, to the point message to your neighbor. Title: Re: Property line disputes Post by: ricky023 on March 19, 2011, 11:58:43 AM Well ask him just plain what would it take for him to see this problem solved? Then see if surveying or what ever he wants for assurance. JMHO. RTR!
Title: Re: Property line disputes Post by: MLB10 on March 19, 2011, 12:21:20 PM We had a neighbor once who tried to "steal" land by ever expanding into my daddy's land (this was out in the country). Well, he had been burned by a "friend" stealing some land similarly before so he ran a fence to the very edge of our property and then stuck an ugly liento right up in their backyard. They were British expats and I don't think they understood how touchy a southerner can get over a piece of dirt. Never had a problem after that...

My family is 2 hours away from you and those do very well in your zone and fill out very nicely. Both my sisters have them to block a neighbor...they like the neighbor but just wanted a more secluded feel since they like to be outside a lot.
