Just in case you all are interested:

SOUTH BEND, Ind. -- Indiana regulators fined Notre Dame $77,500 on Tuesday for six safety violations in the October 2010 death of a 20-year-old student who was killed when the hydraulic lift he was on toppled over in high winds while he was filming football practice.

The school failed to maintain safe working conditions or heed National Weather Service warnings on a day wind speeds in the area reached 53 mph, the Indiana Department of Labor said.

A pitiful amount for the death of that kid. I blame the head coach, who they conviently didn't mention in the report. I hope the parents sue the crap out of him and Notre Dame. This was so senseless.

In most cases, it's the only resolution, due to what is this young mans life worth to his family for a senseless killing.

In most cases I would agree, but in an instance like this, the family generally will receive a much greater compensation from the sympathies of a jury's decision than it could achieve through mediation or any other alternative dispute resolution.

Plus, having a public court hearing makes the court proceedings a matter of public record where we won't have to worry about those found ultimately responsible being "conveniently left out of the report" as Marshall Dillon said which may provide an additional sense of closure for the family as no criminal charges were filed. 

In any case, I don't think ND will want to drag this out as they they have already been found to be at fault and will want to avoid further negative publicity.  I'm certain they will want to settle discreetly outside of the courts, but I won't fault the family as simply being "litigious" for choosing to take it to the courts.

I would guess a smart lawyer would want any civil proceedings against ND to be held outside of South Bend.
