BIRMINGHAM, Alabama — Police in Alabama are getting ready to enforce what is considered by many as the toughest immigration law in the United States.

Beginning Thursday, authorities can question people suspected of being in the country illegally and hold them without bond, and officials can check the immigration status of students in public schools, Gov. Robert Bentley said.

Those two key aspects of Alabama's new law were upheld by a federal judge on Wednesday.

The governor said parts of the law take effect immediately.

"Today Judge Blackburn upheld the majority of our law," Gov. Robert Bentley said in a brief statement he delivered outside the State Capitol in Montgomery, The New York Times reported. "With those parts that were upheld, we have the strongest immigration law in the country."

What's the deal with the Huntsville Police Chief?

Huntsville police chief: Immigration ruling unclear, law won't be enforced yet

Quote
Police Chief Mark Hudson said Wednesday afternoon that a federal judge's ruling upholding policing sections of Alabama's new immigration law is unclear and the law will not be immediately enforced. "This is going to take some lawyers and probably the (state) Attorney General's Office" to sort out, Hudson said Wednesday afternoon. "It's just not clear."

U. S. District Judge Sharon Blackburn denied a U.S. Department of Justice motion to block provisions of the law relating to police enforcement. The law authorizes police officers, when making a stop or arrest, to seek to determine the citizenship status of an individual they have "reasonable suspicion" is "unlawfully present in the United States." If the person being questioned cannot provide proof of legal residence, police can take that person into custody pending a determination of legal status by the federal government.

Reads loud and clear to me.

This law has the support of Decatur and Morgan County. Our Representative, Mickey Hammond, is the one who initiated and pushed the bill through. I support this law 100%.

Applause E-Cred I e-cred you and applaud the Police there and your County for supporting this. I have no problem with people who come here legal but illegals want our Flag burned and support holidays of unnatural days. We have make jobs for Americans that Will Work and these $5 guys are taking up work we could be doing and paying taxes. They don't pay taxes and use up the Medical System. It is not legal and just not right to punish our people for them coming under the fence and having their drug wars here we have enough without them. Do It Legal! RTR!

I am all for the American way. This country was built by immigrants. However, immigrants need to follow all laws, pay taxes, obtain proper health and car insurances and get legal status.

The biggest issue I had with this law was that it made it a crime to transport an illegal, even if you were unaware of their status.  So basically if I gave one of the little hispanic kids a ride home from a little league game I would be in violation of the law if they were here illegally.  They should not pass the buck on to regular citizens to have to determine the status of people.  But that part of the law has not been approved by the judge yet so it is on hold.

The law has to be interpreted with some common sense. I doubt you would get in trouble for giving a kid a ride home from practice. Picking up six of them to take to your farm to work tax free is another matter.

They should write the law in such a way that interpretation is not required.  That interpretation is where you get into trouble.  Barney will interpret it completely different from Andy.  Remember that episode?  Common sense goes out the window where any part of government is involved.  JMHO.

I can not argue with your Andy/Barney logic. I only know what I have read about the law and I like it.

I like the law for the most part, I just think it needs a little tweaking to do away with some unintended consequences.

Hey guys I agree with the idea of "No Interpretation Needed." I do believe Judge Blackburn is going to consider and make it right in her Judgement of the Law of Alabama. Right now the Law Enforcement has the right to move those illegal out if they had children they should go with parents. They should not have done that just to try and get by this law. We should be able now to get some honest workers more work for themselves. I know the lazy will not but we have people will. Please include your thoughts I look for those. RTR!

I think probably what will happen, if the law is upheld, is that most of the illegals will move to another state that does not have this kind of law.  So I guess it solves the problem from Alabama's perspective.

Some will, but this is probably going to be a red state/blue state issue.  The red states will probably all have something similar, while the blue states probably will not.  Just my guess.

I am convinced that the illegals know more about the laws and free handouts than most tax paying citizens. I hope more states follow  because even if they leave our state there is still federal money that affects us. I agree with SC that it most likely will be a red state blue state issue.
